This Product (including any accessories included in the original packaging) as supplied and distributed new is warranted by AVNU digital Inc. ("AVNU") to the original consumer purchaser against defects in material and workmanship ("Warranty").

This Limited Warranty begins on the original date of purchase and continues through the Limited Warranty Period and is valid only on AVNU products purchased from AVNU or an AVNU authorized reseller and used in the fifty (50) United States and the District of Columbia (unless you enter into a separate written agreement with AVNU). Since no end-user purchase takes place, this limited warranty does not apply to a party who rents or leases an AVNU brand product, and such a party must contact its rental or leasing company to determine whether warranty coverage is applicable.

Limited Warranty coverage is as follows:

1. PARTS AND LABOR: For a period of two (2) years from date of original consumer purchase, if this Product or any functional part is determined by AVNU, or a AVNU authorized service provider, to be defective, AVNU will at its sole option, (1) supply at no charge to the original consumer, new, rebuilt or refurbished replacement parts in exchange for defective parts, (2) will replace the Product with new or refurbished product of similar quality, or (3) refund the purchase price of the product LESS THE PRODUCT’S DEPRECIATED VALUE in the event the AVNU is unable to replace or repair the product. AVNU will also pay any approved labor charges to any AVNU authorized service provider. After the applicable Warranty periods, the consumer must pay for all parts and labor costs.
2. SHIPPING COSTS: Notwithstanding the foregoing, the original consumer is responsible for any and all shipping charges incurred to ship the Product or part(s) to AVNU or to an AVNU authorized service provider, for diagnosis, repair or replacement.

To receive Warranty service, the original consumer purchaser must contact AVNU for problem determination and service procedures. Proof of purchase in the form of a bill of sale or receipted invoice, evidencing that the Product is within the applicable Warranty period(s), MUST be presented to AVNU, or an authorized service provider, in order to obtain the requested service. Warranty service can only be performed by an AVNU authorized service center. AVNU will not reimburse for any service performed by others.

Exclusions and Limitations
This Warranty covers manufacturing defects in materials and workmanship encountered in the normal commercial use of the Product, and does not cover (a) damage which occurs in shipment, delivery and installation; (b) loss or destruction of data or media resulting from the use or service of this product, whether due to virus issues or otherwise, or any failure to secure all programs and data contained in or affected by the product or to maintain the confidentiality of data stored on the product; (c) damage or failure caused by or attributable to abuse, misuse, failure to follow instructions, improper installation or maintenance, alteration, accident, or excess voltage or current; (d) improper or incorrectly performed repairs by non-authorized service facilities; (e) on-site consumer instruction or adjustments; (f) transportation, shipping, delivery, insurance, installation or set-up costs; (g) costs of product removal, transportation or re-installation costs; (h) ordinary wear and tear, cosmetic damage or damage due to acts of nature, accident; (h) modification of, or to any part of the Product. In addition, this Warranty does not cover images "burnt" into the screen. This Warranty applies to the original consumer only and does not cover products sold AS IS or WITH ALL FAULTS, or consumables (e.g., fuses, batteries, bulbs etc.), and the Warranty is invalid if the factory-applied serial number has been altered or removed from the Product; (i) applications and uses for which this product was not intended; (j) use of products, equipment, systems, utilities, services, parts supplies, accessories, applications, installations, repairs, external wiring or connectors not supplied or authorized by AVNU; (k) reception or display problems and distortion related to noise, echo, interference or other signal transmission and delivery problems; (l) minor imperfections within design specifications or that do not materially alter functionality. This Warranty is valid only in the United States, and only applies to products purchased and serviced in the United States. All replaced parts and products, and products on which a refund is made, become the property of the Warrantor.

NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE EXPRESSLY DESCRIBED ABOVE SHALL APPLY. THE WARRANTOR FURTHER DISCLAIMS ALL WARRANTIES AFTER THE EXPRESS WARRANTY PERIOD STATED ABOVE. NO OTHER EXPRESS WARRANTY OR GUARANTY GIVEN BY ANY PERSON, FIRM OR ENTITY WITH RESPECT TO THE PRODUCT SHALL BE BINDING ON THE WARRANTOR. REPAIR, REPLACEMENT, OR REFUND OF THE ORIGINAL PURCHASE PRICE - AT THE WARRANTOR’S SOLE DISCRETION -ARE THE EXCLUSIVE REMEDIES OF THE CONSUMER. THE WARRANTOR SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE, MISUSE OR INABILITY TO USE THE PRODUCT. NOTWITHSTANDING THE FOREGOING, CONSUMER’S RECOVERY SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT SOLD BY AVNU. THIS WARRANTY SHALL NOT EXTEND TO ANYONE OTHER THAN THE ORIGINAL CONSUMER WHO PURCHASED THE PRODUCT AND IS NOT TRANSFERABLE.

AVNU SHALL NOT BE LIABLE FOR LOSS OF REVENUE OR PROFITS, FAILURE TO REALIZE SAVINGS OR OTHER BENEFITS, OR ANY OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE, MISUSE OR INABILITY TO USE THE PRODUCT, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, AND EVEN IF AVNU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NO RECOVERY OF ANY KIND AGAINST AVNU SHALL BE GREATER IN AMOUNT THAN THE PURCHASE PRICE OF THE PRODUCT SOLD BY AVNU AND CAUSING THE ALLEGED DAMAGE.

WITHOUT LIMITING THE FOREGOING, YOU ASSUME ALL RISK AND LIABILITY FOR LOSS, DAMAGE OR INJURY TO YOU AND YOUR PROPERTY AND TO OTHERS AND THEIR PROPERTY ARISING OUT OF THE USE, MISUSE OR INABILITY TO USE THE PRODUCT NOT CAUSED DIRECTLY BY THE NEGLIGENCE OF AVNU. THIS LIMITED WARRANTY SHALL NOT EXTEND TO ANYONE OTHER THAN THE ORIGINAL PURCHASER OF THIS PRODUCT, IS NONTRANSFERABLE AND STATES YOUR EXCLUSIVE REMEDY.

If there is any inconsistency between this Limited Warranty to original purchaser and any other agreement or statement included with or relating to the AVNU products or services, this limited warranty shall govern. If any provision of this limited warranty is found invalid or unenforceable, it shall be deemed modified to the minimum extent necessary to make it enforceable and the remainder of the limited warranty shall remain valid and enforceable according to its terms.

Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on warranties, so the above limitations or exclusions may not apply to you. This Warranty gives you specific rights, and you may have other rights, which vary from state to state.

ONSITE SERVICE: During the Warranty period described above, this Warranty includes on-site service (subject to availability) which includes an authorized service provider repairing the Product in the original consumer’s location or removal of the Product for repairs at a AVNU authorized service provider and returning the Product to the original consumer’s location. On-site service is not available in all areas. In order for a consumer to receive on-site service, the Product must be accessible to the AVNU authorized service provider, at an installed height not exceeding 14' from ground level. If specialized equipment is required to access the Product consumer shall be responsible for any and all costs to provide. If on-site service is unavailable, or the repair cannot be completed, AVNU may elect to (i) request that the customer transport their product to an AVNU authorized service center, with the customer being responsible to ship the Product or part(s) to AVNU for diagnosis, repair or replacement, or (ii) replace the Product with new or refurbished product of similar quality, or (iii) refund the purchase price of the product LESS THE PRODUCT’S DEPRECIATED VALUE in the event the AVNU is unable to replace or repair the product.
